Massachusetts State College Association Collective Bargaining Agreement

The massachusetts Community College Council, Massachusetts Teachers Association/NEA Division of Continuing Education (DCE) collective agreement covers the period from June 1, 2018 to August 31, 2020. The collective agreement of the American Federation of State, County and Municipal Employees (AFSCME) covers the period from July 1, 2017 to June 30, 2020. The Supreme Court upheld the Commonwealth Employment Relations Board`s decision to maintain a specific provision in a collective agreement between the Board of Directors of Higher Education (BHE) and the Massachusetts State College Association and found that this provision was subject to appropriate collective bargaining. The impugned provision capped the percentage of courses taught by part-time faculties at commonwealth public colleges. In the appeal, the BHE argued that, even if it had negotiated this provision, the provision was not applicable, as it unduly encroaches on the non-delegated management rights of public conservatories of higher education institutions. The Supreme Court upheld this and held that the provision was valid and enforceable. The collective agreement of the Association of Professional Directors (APA) covers the period from July 1, 2017 to June 30, 2020. This agreement is entered into by and between the Board of Directors of Higher Education and the Massachusetts Teachers Association/National Education Association as the exclusive bargaining agent for positions in the bargaining unit.
